How to dispute an error on your background check

Background-check errors are not rare. Wrong-person matches, dismissed charges recorded as convictions, and records that should have aged off years ago are all common. The dispute process is a federal right with a hard deadline, and it works.

The steps

Do these in order

  1. 01Get the report firstRequest your file disclosure. Disputing from memory does not work, and you need to quote the entry exactly as it appears.
  2. 02Identify the specific legal defectNot 'this is unfair' but which rule it breaks: not my record; non-conviction information older than seven years under § 605; disposition recorded incorrectly; record expunged or sealed and therefore unreportable under § 607(b).
  3. 03Gather the document that proves itA certified disposition, a certified expungement order, or identity documents showing the record belongs to someone else. Documentation converts an assertion into a finding.
  4. 04Write to the agency, not the employerThe agency created the report and the agency has the statutory duty. Identify yourself, identify the exact entry, state the defect, attach the document, and request deletion plus written confirmation.
  5. 05Send it so you can prove it arrivedCertified mail with return receipt, or the agency's portal with a saved confirmation. The date you served them matters later.
  6. 06Diary 30 daysIf the item is inaccurate, incomplete or unverifiable, it must come out within 30 days. If the deadline passes, that silence is itself part of your record of the violation.
  7. 07Ask for the corrected report to be re-sentYou may request that the corrected report go to anyone who received the old one in the past two years for employment purposes. Do it — a correction that nobody sees does not get you the job.
What goes wrong
  • Disputing everything at once dilutes the strong items. Lead with the clearly disputable entries.
  • Do not dispute an accurate conviction as if it were an error. It damages your credibility on the entries that are genuinely wrong.
